Payam Data Recovery - Terms & Conditions of Service

1. The client authorises Payam Data Recovery Pty Ltd, it's employees and independent contractors to receive and transport the device (sent for data recovery) to or from their facilities by courier.
2. The client represents, warrants and affirms that he/she or it is the owner of the device sent for data recovery. 
3. Any property left with Payam Data Recovery Pty Ltd for more than 30 days will be disposed of or recycled. Payam Data Recovery Pty Ltd shall have No liability to the client or any third party.
4. The client understands that data recovery cannot be guaranteed.
5. The client understands that a hard drive, flash drive, memory card or mobile phone may fail at any time even while in the possession of Payam Data Recovery Pty Ltd and shall not hold Payam Data Recovery Pty Ltd for any such failure.
6. In no event will Payam Data Recovery or contractor or, employee be liable for any loss of data, damage to the device, loss of revenue or profit, or any other consequence of the service provided.
7. Payam Data Recovery Pty Ltd agrees to keep all data recovered private and confidential at all times. Any child pornography found must be reported to the Australian federal police as required by law. All other data will remain confidential in accordance with privacy laws. If any data recovered is requested by law enforcement, this will be provided in accordance with the law.
8. Payment is due in full prior to release of data, unless by special previous arrangement.
9. No-Data, No-Fee policy only applies for certain cases. In some cases an initial fee may be requested before work is started. This is always stated in a quote after the evaluation of your device.
10. The client is financially responsible for all shipping costs.
11. Payment Methods accepted: Cash, EFTPOS, Visa, Mastercard, American Express, Diners and bank cheque. 
12. A $250 cancelation fee must be paid if the client approves a quote for any service (regardless of no-data, no-fee policy on most services)  then more than 24 hours later cancels the requested data recovery service without an agreeable explanation. This fee may be waived at the discretion of Payam Data Recovery Pty Ltd.
